### Terms & Conditions for Online Payment by Customer through Oman Payment Gateway Customers willing to pay any dues to Modern Exchange Company L.L.C. (hereinafter MEC) through online Oman-Net Payment Gateway are requested to read the following terms and conditions carefully before making an online payment: 1. By using the online payments service, you accept to adhere to these terms and conditions. If you do not agree with the terms and conditions, please do not process further. These terms and conditions are in addition to and do not supersede other terms and conditions that may be applied by Oman-Net. 2. Payment(s) through online Oman-Net Payment Gateway may only be made with a Oman-Net Card. 3. MEC is only facilitating the payment by providing a link to the Payment Gateway Service provider or the Bank which will enable Customers to pay online. For your convenience, this page may contain certain hyperlinks to access other MEC pages. MEC is not responsible and shall not be liable for the functioning and/or any errors prompted by the link. 4. If any Payment Gateway Service Provider or Bank imposes any taxes or charges, the same shall be borne by the Customer and cannot be claimed from MEC. MEC shall not be liable for any costs, expenses, taxes, penalties and/or charges of any type or nature. 5. The Customer agrees to indemnify and hold MEC harmless against all direct and indirect claims, losses, damages and actions that the customers, payers, payee or any party may initiate in relation to the online payment gateway. Neither MEC nor any of its employees, agents, officers, management or representatives shall be liable for any loss or damage, costs, expenses, charges of any type that may be suffered by customers, payers, payee or any party as a result of such usage. 6. All payments will be processed on the basis of the information that you provide. MEC does not accept any liability if you make any mistake in providing information or for any reason whatsoever. 7. The service is provided using a Third Party payment gateway through a secure website. However, MEC does not give any assurance or guarantees, that the information provided online by a user is kept secured and/or a third party cannot read it or intercept it. MEC and/or its employees, agents, officers, management or representatives do not accept or assume any type of liability in the event of such unauthorized interception, hacking or other unauthorized access to information provided by a user of the online payment service. 8. The Customer declares that he/she is the lawful owner of the money being remitted to the beneficiary and have the capacity and authority to execute this remittance. He / She also declares that he / she have full and complete knowledge of the beneficiary and that the money is being remitted for personal and lawful purposes. 9. The Customer agrees, understands and confirms that his / her personal information including information relating to his/her Oman-Net Card transmitted over the Internet may be susceptible to misuse, hacking, theft and/ or fraud and MEC and/or its employees have no control over such matters. The Customer hereby undertake that, he / she alone shall be transacting through online and shall not share his / her user ID and password to any third party. 10. The Customer agrees that the Oman-Net Card details provided by him/ her must be correct and accurate. The Customer shall not use a Oman-Net Card that is not lawfully owned by him/ her or the use of which is not authorized by the lawful owner thereof. The Customer shall not share these details to any third party and MEC shall not be held responsible in any manner. 11. He / She understand that should this remittance be unpaid for whatsoever reasons by Modern Exchange Company L.L.C. (hence forth and interchangeably known as MEC), I can only claim the value thereof at the buying rate on the day the actual refund takes place. The refund will not take place unless MEC receives definite advice from their correspondents that the remittance remains unpaid and after the completion of necessary formalities to the satisfaction of MEC. Repayment/refund of the aforementioned claim/remittance will be done only to the account of the debit card used at the time of doing the transaction and is at the sole discretion of MEC. He / She hereby indemnify MEC and its employees against any liability whatsoever arising thereof. 12. The information provided by the user on this website will be kept confidential and will not be shared with anyone unless required by law, by regulatory body or by court. 13. Once the payment has been confirmed online, you will be given a Payment Receipt including a transaction number. Please note the transaction number and quote in any future queries about the payment. Payment Receipt so generated shall be the proof for successful payment. 14. We retain the right to change the terms and conditions for Online Payments, without any prior notice. 15. Customer obligation to pay the transaction dues remain unchanged in the event online transaction fails for whatsoever be the reason. 16. Note : Kindly note that you will be contacted in case additional supporting financial documents or other information are required to process the transaction. 17. Modern Exchange Company L.L.C. shall not be liable for any incorrect information and / or documents provided by the Client and the Customer shall be solely responsible for verifying the accuracy of the information provided by him, including the beneficiary's information. 18. The purchase and sale of currencies are subject to financial limits and financial exchange restrictions applied by the competent authorities and compliance with anti-money laundering rules. Customers should seriously note that any suspicious transactions will be reported to the relevant authorities in the relevant countries. Important Notice: The terms and conditions on which the service is provided are set out below. You are advised to read these terms and conditions, especially those restraining liability and data protection, before signing this form, in addition to the transfer fee, Western Union and it's agent also make money from the exchange of currencies.
