These consents & declarations set out the terms and conditions governing the collection, use, storage, sharing, and protection of your personal data by Modern Exchange Co. LLC, P.O. Box: 3401, P.C. 112, MBD, Ruwi, Muscat, Sultanate of Oman (Commercial Registration No.: 1398008), when you register for, access, or use our mobile payment, remittance, and related digital financial services, including electronic Know Your Customer (“eKYC”) processes.

Consent for Collection and Use of Personal Data

I hereby authorize and consent to Modern Exchange Co. LLC, a company licensed in the Sultanate of Oman, to collect, use, verify, store, and retain my personal data, including official identification documents, photograph, and facial image (selfie / biometric data), for the purposes of:

• Customer identification and verification (eKYC);
• Compliance with Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) laws, regulations, and directives issued by the Central Bank of Oman and other competent authorities;
• Prevention, detection, and investigation of fraud, financial crime, and unauthorized transactions;
• Account security and recovery.

Processing of Personal Data

I consent to the processing of my personal data, including identification, contact, employment, financial, transactional, technical, and usage data, to the extent necessary for:

• Opening, operating, and maintaining my account;
• Execution of payment, remittance, and related financial transactions;
• Customer support, complaint handling, and service administration;
• Security and fraud prevention;
• Internal risk management, audit, and compliance with applicable laws and regulations.

Sharing of Personal Data

I consent to the sharing of my personal data with:

• Banks, correspondent banks, payment networks, clearing systems, and beneficiaries involved in my transactions;
• Third-party service providers engaged for identity verification, AML screening, IT systems, cloud hosting, cybersecurity, and operational support, strictly on a need-to-know basis and subject to confidentiality and data protection obligations;
• Regulators, courts, or government authorities where required by law;
• Successor entities in case of merger, acquisition, or sale of business.

Regulatory and Legal Disclosure

I acknowledge and consent that Modern Exchange Co. LLC may disclose my personal data, without further notice, to:

• The Central Bank of Oman and other regulatory or supervisory authorities;
• Law enforcement agencies, courts, or government bodies;
• Auditors and compliance reviewers;

where such disclosure is required or permitted under applicable laws, regulations, directives, or lawful requests.

Cross-Border Data Processing

I acknowledge and consent that my personal data may be processed or stored outside the Sultanate of Oman, where required for operational, technological, or compliance purposes, provided that:

• Such processing is conducted in accordance with applicable laws; and
• Appropriate contractual and security safeguards are in place, consistent with Central Bank of Oman outsourcing and data governance expectations.

Data Retention

I acknowledge that my personal data may be retained during the course of the business relationship and for a period thereafter (which may extend up to 10 years or longer if required), in accordance with:

• AML/CFT regulations;
• Record-keeping requirements;
• Legal or regulatory obligations.

Marketing Communications

I agree to receive information about products, services, offers, and promotions from Modern Exchange Co. LLC via SMS, email, phone calls, in-app notifications, or online channels. I understand that I may withdraw this consent at any time without affecting my access to core services.

Cookies and Tracking Technologies

I consent to the use of cookies and similar technologies to analyze usage, improve app performance, and personalize my experience. I understand that I may manage or disable cookies through my device or browser settings.

Updates to This Notice
