Customers wishing to settle payments to Al Mulla International Exchange
Company (hereinafter referred to as the “Company”) via the Knet online
payment gateway are kindly requested to carefully read these Terms and
Conditions before completing the payment process.

Use of Payment Method
Payment shall be made through the Knet online payment gateway using a
Knet card only.

Acceptance and Commitment
The customer explicitly confirms that he they have read and accepted
these Terms and Conditions, and renews their acceptance of them each
time the service is used, in addition to any supplementary terms or
conditions that may be issued by the Company from time to time.
By using the online payment service, you agree to comply with all the
Terms and Conditions stated herein, and your agreement shall be is
considered as an acknowledgment from you of its correctness. If you do
not agree, please do not proceed with the payment process. These Terms
and Conditions are complementary to any other Terms and Conditions that
may be applied by The Shared Electronic Banking Services Company
(referred to as the “KNET”) and do not override them. The service
provided is intended for personal use only, and the customer is solely
responsible for any transaction conducted through their mobile device
and/or computing devices.

Role of the Company
The responsibility of Al Mulla International Exchange Company is limited
to facilitating the payment process by providing a secured link to the
payment gateway service provider or the bank, which enables customers to
complete online payment transactions. This page may contain links to
other websites affiliated with the Company. The Company shall not be
responsible for any content or damages resulting from such links. The
customer alone shall be held responsible for any losses incurred, or
incurred by Al Mulla International Exchange Company, or by The Shared
Electronic Banking Services Company “KNET” or others, due to fraudulent
activities or any breach of these Terms during the use of the service.

Taxes and Fees
In the event that any taxes or fees are imposed by the payment service
provider or the bank, the customer shall be responsible for settling
them and shall not be entitled to claim any compensation from the
Company in this regard. The Company shall also not be responsible for
any costs, taxes, or penalties arising therefrom.

Indemnity and Liability
The customer agrees to indemnify and defend Al Mulla International
Exchange Company against any claims, losses, damages, or actions arising
from improper use of the online payment service, including any direct or
indirect damages. Al Mulla International Exchange Company, its
employees, agents, officers, or directors, or The Shared Electronic
Banking Services Company “KNET” shall not hold any liability for any
direct or indirect losses, damages, losses, or costs resulting from
delay, interruption, suspension of the service, or any factors beyond
the Company’s reasonable control, or any other losses resulting from the
use of the service.
The customer agrees to the right of Al Mulla International Exchange
Company to stop, freeze, or hold any suspicious or fraudulent transfer
transaction based on a request, notification, or instruction from the
relevant authorities, or a complaint from a third party, or as deemed
necessary by the Company, or upon request from the local bank (the
issuer of the bank card used for the payment). Accordingly, the Company
shall have the right to return or refund the amount(s) to the local
bank, or retain or suspend the amount until a decision is issued by the
official authorities regarding the disposition of the funds, without any
entitlement from the customer to claim compensation.

Provided Information
All payment transactions are processed based on the information provided
by the customer. The Company shall not be responsible for any mistake in
the provided data or for any other reasons related to such information.
The customer acknowledges full responsibility for any losses arising
from any mistakes in the information or instructions provided by the
customer to the Company.

Security
The service is provided through a secure payment gateway; however, the
Company does not guarantee complete security of information provided
over the internet or its immunity from interception or unauthorized
access. The Company shall not be responsible for any breaches or
interceptions of the information provided.

Ownership Declaration
I acknowledge that I am the lawful owner of the transferred funds and
have the legal authorization to carry out this transfer. I confirm that
I am not acting on behalf of any third party, and that the source of
funds is legitimate and lawful, and that the purpose of the transfer is
legal. In case of any violation of this, I accept full legal
responsibility for my actions, and the company shall not bear any legal
liability resulting from my non-compliance with the instructions.

Data Protection
I understand that Knet card data may be exposed to unauthorized use or
fraud, and that the company and its employees are not responsible for
these risks. I commit not to share my login details or password with any
third party.

Accuracy of Information
I acknowledge that all provided data is true and accurate, and that I
will not use a bank card that is not legally owned by me, nor will I
share it with any other party. I further acknowledge that the Company is
not responsible for any unlawful use of such data. I shall be
responsible for ensuring the security of my data and for taking the
necessary precautions to prevent any fraud or unauthorized use of such
data.

Limitation of Liability
I release the Company from any liability or compensation claims for
damages arising from circumstances beyond its control, such as changes
in laws or procedures in the country of transfer. The Company’s
liability shall be limited to refunding the amount after deduction of
applicable fees and exchange rate differences, and I shall not be
entitled to claim any exchange rate differences.

Confidentiality of Information
The data provided will be processed confidentially and privately, and
will not be shared with any third party except in accordance with legal,
regulatory, or judicial requirements. The client alone bears all legal
responsibilities arising from sharing their personal data and
information with any third party or others.

Proof of Payment
Upon confirmation of the payment, a receipt containing the transaction
number will be issued. Please retain it for future inquiries, as it
shall be considered as proof of successful completion of the payment.

General Terms
Non-Compliance with Terms
In the event that any clause of these terms and conditions is
unenforceable, it will not affect the legal validity of the remaining
clauses. Any potential delay in enforcing the company's rights shall not
be considered a waiver of those rights. The company reserves the right
to assert these terms and conditions at any time in the future.
Governing Law, Jurisdiction, and Language:

Any dispute related to the use of the service or the implementation
of these Terms and Conditions shall be subject to the exclusive
jurisdiction of the courts of the State of Kuwait.

These Terms and Conditions are drafted in both Arabic and English.
In the event of any discrepancy between the Arabic and English
versions, the Arabic version shall prevail.
